Michael Coghlan Michael Coghlan
Consultant Personal Injury & Costs Lawyer

I qualified as a Solicitor in 1995, having completed 2 years of Articles with a firm called Beardsells in Stockport, Cheshire.

I was trained primarily as a Personal Injury lawyer with an interest in Credit Hire litigation, and these remain my areas of expertise. I  subsequently joined another firm called Thorneycroft Solicitors in 1996, a relatively small Practise which also specialised in Personal Injury and Credit Hire. The Firm grew rapidly, and I was made one of 3 Partners in 1999. I assisted in the management of what became a rapidly expanding Firm, as well as continuing to deal with my own caseload. The Firm was incorporated in 2008 and I was made a shareholder owner of the Company, subsequently becoming the Technical Director with responsibility for dealing with the numerous changes to the rules that arose with the Jackson Reforms in 2013, again with my own caseload of mainly high-value Personal Injury and Medical negligence cases. This gave me experience in the area of Costs law and in particular the technical arguments regarding Conditional Fee Agreements, and the deductions towards legal fees from Claimant’s damages which Solicitors are legally permitted to make ( as well as those excessive charges that some Firms incorrectly apply).

I am interested in pursuing claims for damages upon behalf of Claimants from Solicitors who have deducted more from their Client’s damages towards their legal costs than they are Contractually or legally entitled to, and this is something that I would like to discuss in more detail about promoting with yourself going forward.

I am also potentially interested in looking into the role of the NHS and/or the Government in the abandonment of patients who have not been treated for serious illnesses over the last 12 months due to the focus being almost entirely upon the Covid Pandemic, possibly ignoring other illnesses such as Cancer. This could be quite a potentially large issue going forward, from a medical negligence standpoint.

In summary, therefore, my areas of specialism, are as follows:

Personal Injury; EL/PL, RTA, Bike accidents, mainly more serious injuries, although I will look at all injuries referred to me initially.

Medical Negligence

Credit Hire Litigation

Costs disputes regarding deductions from damages towards legal fees

Regarding my interests outside of the law, I enjoy watching most sports. I used to play Golf, Football and Tennis when possible prior to the Covid related restrictions now in place, but I can continue to enjoy walking with my family in the beautiful countryside on the doorstep of where I live in Bollington,  Cheshire.

I believe that the flexibility and support afforded to me as a Consultant Solicitor with Setfords will benefit clients and enable me to provide a high level of legal service to them.
