Tenancy Deposit Protection Claims
Have you rented a property on an Assured Shorthold Tenancy (AST)? Did you pay a deposit to your landlord on or after 6 April 2012? If so, your landlord should have protected your deposit within 30 days of receipt, using one of three government-approved Tenancy Deposit Schemes, listed below.
Your landlord should have provided you a certificate evidencing the deposit protection. If you do not have this, your deposit may not be protected. This is in breach of the Housing Act 2004, and you may be able to make a claim. Please follow the links below to check with the schemes whether your deposit is protected:
If your deposit has not been protected, your landlord will likely be in breach of the Housing Act 2004, and you could be entitled to claim up to three times your deposit from your landlord as compensation in a tenancy deposit claim.
Plus, if you have renewed a tenancy without a protected deposit, you may be entitled to further compensation.

Tenancy Deposit Protections Claims FAQs
-
Does my landlord have to protect my deposit?
Yes, if you have an assured shorthold tenancy (AST) in England and Wales, your landlord is legally required to protect your deposit in one of the three government-approved tenancy deposit schemes within 30 days of receiving it.
-
How do I check if I have a tenancy deposit claim?
To determine if you have a tenancy deposit protection claim, consider the following:
- Deposit Protection: Check if your landlord protected your deposit within 30 days of receiving it.
- Prescribed Information: Verify if your landlord provided you with the prescribed information about the deposit protection within 30 days.
- Return of Deposit: Check whether your deposit was returned at the end of your tenancy and if any deductions were made.
You can check with each of the three tenancy deposit schemes to see if your deposit was protected. If your landlord failed to protect your deposit or did not provide the prescribed information, you may have a valid claim.
-
How much is my tenancy deposit claim worth?
If your landlord failed to protect your deposit or provide the prescribed information, you could be able to claim up to three times the amount of the deposit. For example:

- For a deposit of £5000, your claim could be worth up to £15,000
- For a deposit of £10,000, your claim could be worth up to £30,000
