  • What is corporate manslaughter?

    Corporate manslaughter is a criminal offence where an organisation causes a death through a gross breach of the duty of care owed towards them.

  • Who can be prosecuted for corporate manslaughter?

    Only organisations (including companies, public bodies, and public services) can be prosecuted for corporate manslaughter. Individuals cannot be prosecuted for corporate manslaughter, although they can still be prosecuted for other offences where relevant, including breaches of health and safety legislation or gross negligence manslaughter.

  • What is a duty of care?

    Organisations have certain legal obligations to ensure the reasonable safety of individuals, including employees and members of the public using or connected to the organisation.  Organisations must conduct risk assessments to identify potential hazards and put measures in place to minimise or eliminate the risks.

  • What is a gross breach of duty of care?

    To be prosecuted for corporate manslaughter, there must have been a gross breach in the organisation’s duty of care that contributed to the death. Essentially, a gross breach ‘falls far below what can reasonably be expected of the organisation in the circumstances,’ according to the Corporate Manslaughter and Corporate Homicide Act 2007.

    The Corporate Manslaughter and Corporate Homicide Act 2007 is a piece of UK legislation that made it more straightforward to prosecute organisations for corporate manslaughter. It shifts the focus away from individuals towards systemic failings within the organisation and senior management.
