In April 2025, the Ministry of Justice implemented an increase in court and tribunal fees, in line with inflation and subject to parliamentary approval. These adjustments ensure that fees keep pace with the costs of running His Majesty’s Courts and Tribunals Service (HMCTS), while also minimising the financial burden on taxpayers. The revenue generated will be used to improve service delivery, subsidise court and tribunal services that remain free, and maintain efficiency within the system. For those struggling financially, the Help with Fees remissions scheme remains available to support eligible applicants.
When planning any legal application, it is essential to understand what costs you may incur. Whilst several family fees have increased, the most common ones are listed below.
Divorce
The fee for filing a divorce, nullity, or civil partnership dissolution application has risen to £612 (previously £593).
Financial Order
For financial orders that are not by consent, the application fee is now £313 (previously £303).
Financial Consent Order
If both parties agree to the financial order, the fee for a consent-based financial order is £60 (previously £58).
A Child Arrangements Order
Applications for child arrangements orders, including prohibited steps and specific issue orders, now cost £263 (previously £255).
When is there no court fee payable?
Certain applications remain free of charge, including:
- Non-molestation orders
- Occupation orders
- Domestic Abuse Protection Orders
- Forced marriage and FGM protection orders
Why are non-molestation and occupation orders free?
These applications are exempt from fees because they are designed to protect individuals from harm or unsafe living conditions. The government ensures that financial barriers do not prevent people from seeking urgent legal protection.
