1.1 www.setfords.co.uk (the “Website“) is operated by Setfords Law Ltd, trading as Setfords Solicitors (“Setfords“, “we“, “us“, “our“). We are a company registered in England and Wales under company number 09568377, with our registered office at 74 North Street, Guildford, Surrey, GU1 4AW. Our VAT number is 221348538.

1.2 Setfords is authorised and regulated by the Solicitors Regulation Authority (“SRA“) under SRA number 622970. You can check our regulatory status on the SRA register.

1.3 These Terms of Use, together with our Privacy Policy and Cookies Policy, govern your use of the Website. By accessing or using the Website, you agree to be bound by these terms. If you do not agree, please do not use the Website.

1.4 These terms apply every time you visit or use the Website. If you provide access to the Website to anyone else (for example, on a shared device), you are responsible for making sure they are aware of, and comply with, these terms.

1.5 These terms do not apply to any separate engagement between you and Setfords for the provision of legal services. If we act for you, the terms of that engagement (including our client engagement letter and terms and conditions) will govern that relationship and will prevail over these terms in the event of any conflict.

2.1 We may update these Terms of Use from time to time — for example, to reflect changes in the law, in our services, or in how the Website works. The date at the top of this page shows when the terms were last revised. We recommend you check back periodically.

2.2 We may also update, change, suspend, or withdraw all or part of the Website (or restrict access to it) at any time, for business or operational reasons, without notice. The Website is provided free of charge and we do not guarantee that it, or any part of it, will always be available or uninterrupted.

4.4 If we reasonably believe you have breached this section, we may withdraw your access to the Website, issue a warning, take legal action against you (including to recover costs), and/or disclose information to law enforcement, as we consider appropriate. This is without prejudice to any other rights or remedies available to us.

5.1 Except where otherwise indicated all content on the Website — including text, graphics, logos, and design — is owned by Setfords or our licensors and is protected by copyright and/or any other applicable intellectual property laws. All rights are reserved. You must not claim any of the form or content on our Website as your own intellectual property and you must not use or reproduce any of our content in a manner which appears as if it is your own intellectual property.

We will take action wherever we become aware that any unauthorised use and/or infringement of Setfords’ intellectual property or other rights and/or passing off has taken place.

A solicitor-client relationship is only formed once we have expressly agreed to act for you, in writing.

7. Online payments

7.1 Where the Website allows you to make a payment to us (for example, via our payments page), such payments are processed securely by our third-party payment provider. We accept online payments in GBP only.

7.2 Making a payment through the Website does not, of itself, constitute or vary any instruction, retainer, or agreement between you and Setfords. Please only make payments when prompted to do so by Setfords and please note our Refunds Policy (available on our Website), the guidance on the ‘Payments’ section of our Website (including the limits we place on online payments) and other applicable clauses in our standard Terms and Conditions as amended from time to time. Please also be aware of the risks of redirection fraud and other fraudulent practises associated with the use of legal services – if in doubt, please speak with your lawyer before making any payments.

We do not endorse, and are not responsible for, the content, accuracy, or availability of any third-party site, and linking to one does not imply any association or approval on our part.

8.2 You explicitly agree to release us from any claims and/or disputes arising from or connected with your use of any third party website or resource.

9. Linking to our Website

9.1 You may link to content available on our Website, provided you do so fairly, legally, and in a way that does not damage or take unfair advantage of our reputation, infringe any of our intellectual property rights and/or constitute passing off.

10.4 Where we act for you under a separate engagement for legal services, our liability in connection with that engagement is governed by the terms of that engagement, not by anything on our Website or these Terms of Use.

11.1 We process personal information in accordance with our Privacy Policy and Cookies Policy. Any data protection request should be made in accordance with the terms of our Privacy Policy and our Terms and Conditions.

13. General

13.1 If any provision of these terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision will be severed, and the remaining provisions will continue in full force and effect.

13.2 Our failure to enforce any right under these terms does not amount to a waiver of that right, and we reserve the right to enforce any right at a later date as we see fit. Any single waiver of any right does not amount to a general or collective waiver.

13.3 We may transfer our rights and obligations under these terms to another organisation. We will notify you in writing if this happens, and your rights under these terms will not be adversely affected.

13.4 These terms, their subject matter, and their formation (including any non-contractual disputes or claims) are governed by the law of England and Wales. By using the Website, you agree to submit to the exclusive jurisdiction of the courts of England and Wales.
