Once the moving vans have left and you’re settling into your new home, your solicitor enters the final invisible phase of the journey: ensuring your ownership is officially and securely recorded.
The registration process
Registering your property with HM Land Registry is a legal requirement in England and Wales. This process moves your name from the contract of sale into the public record, which is the ultimate protection of your rights as an owner.
Your solicitor handles this by submitting a digital application including the TR1 (Transfer Deed), which is the legal document that officially passes the property to you, along with your mortgage particulars to record your lender’s legal interest, and your SDLT submission receipt as proof that all Stamp Duty liabilities have been settled with HMRC.
The registration gap
It’s a common misconception that registration happens overnight. The Land Registry is currently processing a record volume of applications, leading to what’s known as the registration gap. For a straightforward purchase of a whole property, expect the process to take 6 to 13 months. New builds and first registrations are more complex, currently taking between 13 and 22 months due to the extra verification required.
The important thing to understand is that your legal interests are protected from the moment your solicitor submits the application. This creates a priority period that prevents any other claims from being made against the property while your registration is pending.
Proof of ownership
In the digital era, title deeds are no longer a bundle of old parchment. Once registration is complete, your solicitor will send you an Official Copy of the Register. Until that document arrives, your Completion Statement and the signed TR1 deed serve as your legal proof of purchase. You don’t need to wait for registration to finish if you want to sell the house or remortgage in the future, the pending application is legally sufficient for almost all transactions.
