A head injury can turn your world upside down in seconds. One moment, you’re going about your day, and the next, you’re in pain, confused, and facing weeks or even months of uncertainty. You may be off work, struggling to concentrate, or finding daily life more difficult than before.
If your injury was caused by someone else’s carelessness – whether on the road, at work, in public, or through medical treatment – you may be entitled to compensation. This blog from Suzanne Trask, Senior Consultant Clinical Negligence and Personal Injury Solicitor, will guide you through what that means, how to get started, and why speaking to a solicitor could be one of the most important steps you take.
What Is a Head Injury?
Head injuries can happen in many ways. Some are minor, like a bump or mild concussion. Others are more serious, involving damage to the brain, memory, or the way you think and feel. You might hear doctors use terms like “traumatic brain injury” (TBI) or “post-concussion syndrome.”
Even a “mild” head injury can have a big effect on your life. You may:
- Feel dizzy, tired, or sick
- Have headaches or trouble sleeping
- Struggle with memory, concentration, or speech
- Feel more emotional or easily upset
- Need help with everyday tasks
These symptoms may last for a few days, weeks, or much longer – and they might not be obvious straight away. That’s why it’s important to get checked by a doctor after any blow to the head, no matter how small it seems.
When Can You Make a Compensation Claim?
You can usually make a claim if your head injury was caused by:
- A road traffic accident – as a driver, passenger, pedestrian, or cyclist
- An accident at work – especially if you weren’t given the right training or safety equipment
- A fall in a public place – such as slipping on a wet floor with no warning sign
- An assault or criminal injury – even if the attacker was never caught
- Medical negligence – such as a delay in diagnosis or poor treatment of your injury
The common thread in all these situations is that someone had a responsibility to keep you safe – and they failed.
What Can You Claim For?
Compensation is meant to put you, as far as possible, back in the position you were in before the injury. While it can’t take away what happened, it can help you move forward.
You may be able to claim for:
- Pain, suffering, and loss of quality of life
- Loss of income or future earnings
- Medical treatment, physiotherapy, or counselling
- Help from carers or family members
- Transport, travel costs, and adapted equipment
- Any future support you may need, especially for long-term brain injuries
Each case is different. A good solicitor will take time to understand how the injury has affected your life now – and how it might affect your future.
How Long Do You Have to Make a Claim?
The general time limit is three years from the date of the injury, or from when you first knew it was connected to someone else’s fault.
There are some exceptions:
- Children – the three-year limit starts on their 18th birthday
- People without mental capacity – there may be no time limit unless capacity is regained
- Criminal injuries – these usually have a two-year time limit
If you’re unsure, it’s best to get advice as soon as possible so you don’t miss your chance.
What If You’re Unsure Who Was at Fault?
You might not know all the facts straight away – and that’s okay. You don’t need all the answers to speak to a solicitor.
We can help gather evidence, speak to witnesses, request accident reports or medical records, and work out who was responsible. Many clients come to us uncertain about their rights – and leave feeling informed and supported.
Why It’s Important to Choose the Right Solicitor
Head injury cases can be complex. They often involve expert medical evidence, careful calculations of future needs, and a sensitive, tailored approach. Not all solicitors have this experience.
By choosing a solicitor who understands head and brain injuries, you can feel confident that your case will be handled with the care it deserves. You also want someone who listens, explains things clearly, and fights for the best outcome for you.
