Nicola has over 8 years of experience advising on UK immigration law and has represented many of the world’s largest companies encompassing many of the FTSE 100 and Fortune 500 companies across a broad range of industries including the engineering, financial services, healthcare, insurance, media, oil and gas, real estate, sports, technology and telecommunications sectors.
She provides strategic immigration advice to businesses on navigating the UK immigration law system and has managed immigration law matters for a diversified portfolio of corporate clients encompassing multinational corporations (MNC’s), small to medium sized enterprises (SME’s), hedge funds, charitable organisations and for one of sport’s leading international governing bodies.
She has worked collaboratively with corporate clients in establishing business presence in the UK through managing sponsor licence applications and sponsor licence renewal applications for micro, small and large UK organisations. She has extensive experience advising clients on UK sponsor licence related issues, including audits and compliance and issues relating to corporate restructurings including mergers and acquisitions.
Once a sponsor licence has been granted, companies can apply for either of the following two Tier 2 visa types to hire a non-EEA national to work in the UK:
Tier 2 (General) visa
This visa is for new hires who have been offered a skilled job in the UK which meets the minimum salary requirement as defined by the Home Office and which cannot be filled by a settled worker. The job must be skilled to at least Regulated Qualifications Framework (RQF) Level 6, or be a creative sector occupation skilled to at least RQF Level 4. This category includes applicants coming to the UK to fill shortage occupations as defined on the Home Office’s Shortage Occupation List.
Tier 2 (Intra-Company Transfer) visa
This visa is for existing employees of a multinational employer who need to be transferred to a UK branch for training purposes or to fill a specific vacancy that cannot be filled by a settled worker, either on a long-term basis or for frequent short visits. You cannot use this route for employees of an overseas employer that is not linked by common ownership or control to the UK branch. The job must be skilled to at least Regulated Qualifications Framework (RQF) Level 6, or be a creative sector occupation skilled to at least RQF Level 4.
