If you and your spouse are divorcing and have reached an agreement about your finances you can ask the court to approve the arrangements.

This can be done by sending a written agreement, known as a consent order, to the court with a summary of your financial position. A judge will consider the papers you have sent and provided the agreement is considered to be fair, it will usually be approved.

  • Agreements and promises you are making to each other and to the court to do or not do certain things.
  • Orders for a sale or transfer of property or other assets, payment of a lump sum of money, payment of maintenance, sharing of a pension.
  • Clean break provisions which ensure that financial claims cannot be made in the future.

Do I need a Consent Order?

Although it is not compulsory to have a Consent Order when you are divorcing you will need one if you want to ensure that your spouse cannot make any further financial claims against you in the future as there is no time limit to the making of such claims unless your spouse has married again and they did not issue a claim beforehand. You will also need a Consent Order to be able to enforce payment of maintenance at a later date or if you are sharing a pension.
